Welcome to Anya Pilates Glasgow (“APG”). We want you to enjoy and benefit from your Pilates classes and have as positive an experience as possible. However, as with all forms of physical exercise, there is a risk of injury associated with Pilates. To this end the terms and conditions below, and health questionnaire, are set out to help you get the most
from your Pilates and to safe-guard you and our classes for everyone's benefit.

1) Payment
(a) Payments, Cancellations & Refunds Block Booking. Block bookings made are final and once purchased, are non-refundable, non-changeable and not transferable to another person. This is because we limit the number of clients who can attend each class; once a class is fully booked, no other bookings will be taken. No refunds or exchanges can be given, so please be sure of your purchase.
(b) Class/ online bookings and individual appointments. Please cancel your reservation at least 24 hours before the start of class or session. Cancellations 24 hours or less from the class start time and no shows are charged for. We are sorry, they cannot be swapped for another class or made up. As such, if you would like to cancel or modify a reservation or
appointment, please contact us as soon as possible.
(c) Cancelled classes If there are not enough people booked into the class to run it for the term, we reserve the right to cancel the class. A full refund will be given to you. We reserve the right to change the teacher or cancel the class/session if the teacher is unavailable due to illness or any other circumstances. An alternative session will be offered or a
credit given in relation to the missed session.
(d) Late arrivals. If you are late to class we reserve the right to refuse to allow you to join the class (for example if there will be no opportunity for you to properly warm up). In such circumstances the refund of any fees paid will be at the discretion of APG.
2) You will receive from APG:
(a) Expert, experienced teaching from suitably qualified Pilates teachers. Qualifications are available for inspection;
(b) Limited class sizes in studio;
(c) Use of the studio; and
(d) Equipment use (in studio); or
(e) online classes (whereby equipment will not be supplied by APG).
3) Liability Release
You are responsible for your own health and safety. To reduce and avoid injury, we recommend that you check with your doctor before beginning any fitness programme. We would suggest that any pre-existing medical condition or injury be notified to the instructor prior to class in order that alternatives may be suggested for you where appropriate. If any exercise causes you discomfort or e.g. dizziness you must stop preforming that movement. We are always happy to discuss any condition however we are not, and nor do we purport to be, qualified medical professionals or advisers.
(a) I understand that my teacher is a suitably qualified and insured Pilates teacher;
(b) I understand that my teacher is not a qualified doctor, nurse, physiotherapist or other healthcare professional and does not hold herself out as such and does not purport to give healthcare advice;
(c) I understand that I am solely responsible for my health and well-being and for taking all reasonable steps to avoid injury to myself and others. To this end I will;
(i) tell the teacher of anything painful / unusual I experience in the class and
between classes;
(ii) stop doing the exercise if I or s/he thinks I need to, or follow the alternatives my teacher gives me (if I feel able to do so);
(iii) follow my teacher's directions, so far as I am able to do so;
(iv) familiarize myself with all health and safety rules on the premises and comply with those; and
(iv) do anything else necessary to reduce the risk of personal injury to myself and
others.
(d) I understand my teacher may offer me (non-medical) advice relating to my ability to exercise and s/he may consider it unprofessional to continue to teach me, and may refuse to teach me, if I do not wish to follow that advice. I understand that such advice is not medical advice and that I am advised to seek medical advice in relation to any concerns I may have;
(e) I understand that if I undertake any Pilates exercise outwith the Studio/ without my teacher present I do so entirely at my own risk;
(f) I confirm that the completed Health Questionnaire is true and accurate to the best of my knowledge and belief.
(g) Exclusion and Limitation of Liability. I understand that Pilates, as with all exercise, carries a risk of death or personal injury and I voluntarily participate in Anya Pilates Glasgow classes with full knowledge that there is risk of personal injury, property loss or death. I agree that neither I, nor my heirs, assignees or legal representatives will sue or make any other claims of any kind whatsoever against Anya Mcghee, Anya Pilates
Glasgow or her associates for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise;
(h) Anya McGhee (trading as Anya Pilates Glasgow or otherwise) will not be responsible or liable for any loss, injury or harm sustained as a result of, or in connection with this fitness programme, studio classes, online classes, private sessions, online video or information shared on our website.
(i) Notwithstanding the foregoing, any liability of Anya McGhee (trading as Anya Pilates Glasgow), for any loss, injury or harm sustained as a result of, or in connection with this fitness programme, online classes, private sessions, online video or information shared on our website. This includes (but is not limited to) Zoom (or other platform) classes (group and individual), videos (on Vimeo or otherwise), emails, videos and text, of whatever nature and howsoever occurring is limited to £10,000,000.
(j) The foregoing clauses shall be construed separately,
Whilst we hope you enjoy our online classes there are a few ground rules to keep you safe and to keep ourselves right- as we can’t see what you’re doing online!
It is the responsibility of the participant to ensure:
(a) There is sufficient space to perform the exercises safely and move freely without obstacles or obstructions, free from furniture, equipment and other hazards.
(a) Any equipment is safe and in a suitable condition for the activity being performed.
(b) The floor space used is non-slip and entirely clear and free from any hazards that may increase the risk of slips, trips or falls.
(c) There are no distractions throughout the duration of the session.
(d) There is sufficient heating, lighting, ventilation and hydration.
(e) They follow the instructor’s guidance as closely and as carefully as possible and insofar as they are physically able to do so. If any movement is uncomfortable, causes pain or is simply impossible, please do not persist with it- instead, please either stop the exercise in question or try any suitable alternatives suggested by the instructor.
(f) Any weights (or other equipment) used are suitable to the participant’s physical ability, level of fitness and used appropriately. Care must be taken when lifting or replacing weights.
Remote sessions render supervision by the instructor of a group class impossible, and as such we do not purport to supervise participants. In particular, observation on Zoom is very limited. By performing any exercise without supervision (or restricted supervision) you are doing so at your own risk.
(a) Premises Please note that APG is not liable as an occupier under the Occupier’s Liability (Scotland) Act 1960. APG may change the location of classes at any time subject to reasonable prior notification being given.
(b) Health and Safety Regulations. Please note that all health and safety regulations notified at the Premises much be observed (including, but not limited to, Covid-19 related restrictions).
(c) Equipment We supply all the equipment you need, including mats, however for hygiene and comfort reasons, you may like to bring your own equipment to class. For hygiene reasons we ask that outdoor footwear is removed prior to entering the studio.
(d) Lost Property
(i) Whilst our studio is as safe and secure as possible, your belongings are left in the studio at your own risk. We cannot be held responsible for anything broken, lost or stolen.
(ii) If you think you have left something in the studio, please let us know and we will endeavor to find it for you.
(a) It is your responsibility to provide an area suitable for your Pilates session. Your instructor will assist you with that. Any health and safety issues (both personal or relating to the premises) should be notified to the instructor beforehand;
(b) APG can provide equipment or you may choose to use your own;
(c) The instructor will use reasonable endeavours to arrive on time. If the instructor is more than 15 minute late you may choose to the cancel the session in which case any payment made will be credited/ no charge will be levied for the session. Likewise, if you are more than 15 minutes late the instructor may cancel the session however no refund will be due to you.

By attending any of our classes (online, studio or private) you agree to the foregoing terms and conditions. Please note that these terms and conditions are subject to variation; variations will be circulated to clients/ placed on our website.
By continuing to attend classes subsequent to such variation you are deemed to have accepted the same.
